General terms and conditions of sale

Article 1 - General Provisions

  1. These General Conditions of Sale (hereinafter General Conditions) apply, without limitation or condition, to all sales of products marketed by Libra Cosmetics Group SRL ,Piazza F.Filippi 18
    36063 - Marostica (VI) , C.F and P.IVA 04475420248    .
    All sales are made electronically through www.libranailslab.it (referred to as the Site).
  2. Libra Cosmetics Group SRL conducts its business under the brand name "Libra Nails Lab." Therefore, any reference to "Libra Nails Lab," whether in this document, in e-mail addresses, in product information, and/or in any other documentation related to the sales regulated herein, should be considered as direct and referring to Libra Cosmetics Group SRL.
  3. Before proceeding to confirm the order, the Customer agrees to read the General Terms and Conditions on the website www.libranailslab.it in the section "General Terms and Conditions of Sale."
  4. "Libra Nails Lab " reserves the right to change the General Conditions at any time and without notice. It will be the Customer's responsibility to verify any changes made with each purchase.
  5. The General Conditions are made available on the Site in a format that allows them to be stored and reproduced by the Customer, as required by Art. 7.1. 12, co. 3 of Legislative Decree No. 70 of April 9, 2003.

 

Article 2 - Purpose

  1. '''Libra Nails Lab,''' through the Site, remotely sells cosmetic products and nail care equipment, including specialized products intended for professional use only and not available to the public (hereinafter, for brevity Products). Products intended for professional use only may be purchased only by customers who declare under their sole responsibility that they are certified beauty professionals or that they use the products under the supervision and control of an aesthetic professional.
  2. It is understood that, in any case, the Products may not be intended by Customers for sale/resale to third parties, unless expressly authorized by Libra Cosmetics Group SRL.

 

Article 3 - Customers

  1. These general conditions apply to all natural and/or legal persons who purchase Products through the Site (hereinafter Customer/Customers).
  2. The rights and powers reserved by law and / or these general conditions to consumers may not apply in all cases where the Products are purchased for purposes related to the business and / or professional activity carried out by the Customer in the field of 'aesthetics.
  3. The Customer, by accepting the General Conditions, declares that he/she has full capacity to act as well as all the powers and requirements necessary to purchase the Products.
  4. It is forbidden to enter false and/or invented data in the registration form. Personal data and e-mail must correspond exclusively to those of the Customer. It is also forbidden to make untrue statements for the purpose of concluding the contract.

'' Libra Nails Lab '', consequently, assumes no direct or indirect liability for any reason whatsoever arising from the use/inclusion of false/invented or false data/information/statements.

Article 4 - Pre-contractual information

  1. The Customer, before the conclusion of the purchase contract, examines the characteristics of the Products that are illustrated in the individual data sheets on the Site. The images accompanying the Products do not constitute a contractual element. In fact, due to the technical characteristics of the different media used for display, the same may differ in the accessory elements (in particular shades and shades of color).
  2. The Products comply with the applicable legislation in Europe in force at the time of the Order. "Libra Nails Lab " cannot be held responsible for the non-compliance of the Products with the legislation of the different country where the Customer intends to use them.
  3. '''Libra Nails Lab''' may change the assortment of Products and/or information about them, such as prices, descriptions, or availability, at any time without notice.
  4. The Customer may, at any time and in any case before the conclusion of the contract, become acquainted with the identification data of the ''Libra Nails Lab'' (address, telephone number, e-mail address). This information is also given below:

Article 5 - Orders

  1. At the first order request, entered by the Customer following the instructions on the Site, the automatic system requires the Customer to fill in a special form with the personal data necessary for billing and the shipping address. The account can be changed by the Customer at any time.
  2. The information and personal data provided by the Customer must be exact, accurate, true and up-to-date. Any damages/delays/disruptions resulting from the Client's incorrect data entry will be the Client's sole responsibility.
  3. Before the final confirmation of the Order, the Customer is informed about it:

- the essential characteristics of the Products in the shopping cart;

- the total price of the Products including taxes, with details of shipping and any other costs;

- methods of payment;

- The deadline by which "Libra Nails Lab " agrees to deliver the Products.

- the conditions, terms and procedures for exercising the right of withdrawal and the associated costs of returning the goods, the existence of the legal guarantee of conformity of the purchased goods, through a link to these general conditions of sale.

  1. The Customer, after reading the General Terms and Conditions and Privacy Policy and accepting them by ticking the appropriate flag, must select the desired payment method and choose the "send order" option.
  2. The status of each order can be checked by accessing the "Orders" area of your account.

Art. 6 - Conclusion of the contract - Confirmation of order.

  1. The contract of sale between ''Libra Nails Lab '' and the Customer is concluded only upon receipt by the Customer of the order confirmation sent to the e-mail address entered during registration.
  2. ''Libra Nails Lab '', if it is unable to fulfill the order received, reserves the right to cancel it. In this case ''Libra Nails Lab '' will notify the Customer of the cancellation of the order within 5 days of receipt and will refund any amounts already paid by the Customer.
  3. '' Libra Nails Lab '' also reserves the right to cancel the order received if there are objective indications (including third party reports) from which it can be inferred that the Customer resells the Products to third parties.
  4. The order confirmation e-mail contains the Customer's data, the order number, a summary of the General Conditions, the essential characteristics of the product ordered, its price, the amount paid, the existence of the right of withdrawal if a consumer (with an indication of the time and method of returning the goods), the address for submitting any complaints, and information on existing support services and commercial guarantees.
  5. In order to ensure the correctness and traceability of the order to the customer who placed it, "Libra Nails Lab " does not allow changes and / or additions to orders placed. The Customer may request, by e-mail and / or by telephone to the addresses indicated on the Site, the cancellation of the order only on condition that the request is made by 14.00 hours on the day of entry or, in the case of an order entered after 14.00 hours, by 14.00 hours of the first working day following.
  6. Without prejudice to the provisions of Article 5, paragraph 2 of these General Conditions, the Customer undertakes to verify the correctness of the personal data contained in the order confirmation. Any corrections will be taken into account only if they are received by 14.00 on the day of entry or, if the order is placed after 14.00, by 14.00 on the first working day following. In the absence of such notice, "Libra Nails Lab " cannot be held liable for any consequential damages / delays / inefficiencies.

 

Article 7 - Prices

  1. Sales prices shown on the Site are inclusive of V.A.T. and refer only to products sold online.
  2. ''Libra Nails Lab'' reserves the right to change prices at any time. It is understood that the price applied to the Customer will be the price in effect at the time of order entry and indicated in the Order Confirmation, without regard to price increases or decreases, including for promotions, that may occur subsequently.
  3. Subject to any ongoing promotions duly advertised on the Site, shipping charges are not included in the purchase price.
  4. For domestic orders over € 70.00 shipping is free of charge. For domestic orders less than € 70.00 shipping costs are charged to the Customer and are indicated and calculated at the conclusion of the purchase procedure before payment.
  5. For international orders over € 150.00 shipping is free of charge. For international orders less than € 150.00, shipping costs are the responsibility of the Customer and are indicated and calculated at the conclusion of the purchase procedure before payment.

 

  1. In the event of a computer, manual or technical error or any other nature that may result in a substantial change in the retail price to the public (not foreseen or foreseeable by ''Libra Nails Lab'') and that makes it exorbitant or manifestly insignificant, the purchase order will be considered invalid and cancelled and the amount paid by the Customer will be refunded within 14 days. from the day of cancellation.

Article 8 - Method of payment

  1. ''Libra Nails Lab '' accepts payments made through PayPal or Google Pay with credit cards belonging to the following circuits:
  • Visa
  • MasterCard
  • American Express
  • Master

The transaction will be charged to the Customer's credit card only afterwards:

  1. (a) credit card information has been verified;
  2. (b) debit authorization has been received from the credit card issuer used by the Customer.
  3. ''Libra Nails Lab'' also accepts payment by bank transfer. To use this payment method, contact customer service at info@libranailslab.com before placing your order.

 The transfer must be made to ''Libra Nails Lab'' and the reason for the order must be the order number. The transfer must be made within 5 business days of the order. If ''Libra Nails Lab '' does not receive any payment within 8 days of the order, it is considered cancelled without further notice. Any bank charges will be borne by the Customer.

  1. In the event that the crediting of the amounts due proves to be impossible, for any reason even not attributable to the Customer, the Order is automatically cancelled.

Article 9 - Shipping and delivery of products

  1. The Products are shipped by express courier to the address indicated by the Customer at the time of order. Deliveries will be made within 24-48h from the date of shipment for domestic orders ( except delays caused by the couriers and in any case not attributable to us)
    Orders received by 11.00 am will be shipped within the same day, except delays caused by a large number of shipments to be made.
    For international orders ( europe) express deliveries usually take place between 2 and 4 working days, however we can not be responsible for any delays caused by couriers.

  2. These delivery terms are purely indicative and are not binding on ''Libra Nails Lab'' . In any case, in accordance with the rules set forth in Article 61 of the Consumer Code, ''Libra Nails Lab '' undertakes to deliver the Products to the Customers within 30 days from the order confirmation.
  3. "Libra Nails Lab ", therefore, cannot be held liable for any damages caused to the Customer and/or the recipient of the Products by the delay in delivery of less than the term of 30 days from the order confirmation.
  4. The Customer is required to check the Products and packaging upon delivery, accepting them if there are any "reservations" discrepancies.

Article 10 - Customs

Should products ordered on the Site (www.libranailslab.it) be delivered to countries outside the EU, the customer may be subject to import duties and taxes, payable once the package reaches its destination. Any additional costs for customs clearance will be borne entirely by the customer;

 ''Libra Nails Lab'' is unable to predict the amount of these costs over which it has no control. For information on customs policies of foreign countries, please contact your local customs office.

Article 11 - Consumer's right of withdrawal ( returns )

  1. In accordance with the provisions of Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014 (hereinafter referred to as the Consumer Code), the consumer customer has the right to withdraw from the purchase without penalty and without specifying the reason within the term of 14 days from the date of receipt of the Products. In the case of multiple purchases made by the Customer with a single order and delivered separately, the term of 14 days starts from the date of receipt of the last Product.

Once we receive the products and verify their integrity, we will refund the cost of the item ( excluding shipping costs )on the same payment method initially used by the customer ( except cash on delivery ).

 

  1. In case of exercising the right of withdrawal, the consumer customer shall return the Products to "Libra Nails Lab" without undue delay and in any case within 14 days from the date on which he/she forwarded the above notice.
  2. Products must be returned undamaged, in the original packaging, complete in all their parts (including packaging and any documentation and ancillary equipment)
  3. Return shipping costs are the responsibility of the consumer.
  4. In accordance with the provisions of Article 57, paragraph 1 of the Consumer Code, the return costs will be borne exclusively by the Consumer Customer. Packages sent at the recipient's expense will not be accepted.
  5. Pursuant to Article 59 of the Consumer Code, Libra Cosmetics Group SRL will not accept returns in case of:

- Purchase of clearly customized goods;

- Purchase of sealed goods that are not suitable for return for hygienic reasons (including cosmetics,TIPS and/or fake nails for application on natural nail, all tools such as cutter bits, files, buffers and personal care equipment) and that have been opened after delivery.

8. The Customer is in any case liable - even in the event of failure to remove the seals of the Product and/or its packaging - for a decrease in the value of the Product and/or its packaging, caused by the handling of the Product and/or its packaging.

9. Without prejudice to the right to verify compliance with the above, ''Libra Nails Lab'' will refund the amount of the Products subject to withdrawal including shipping costs incurred for the purchase, within a maximum period of 14 days from receipt of the return, as required by Article 56 paragraph 1 of the Consumer Code.

 

Art. 12 Legal warranty.

  1. In accordance with the provisions of the Consumer Code, Products purchased by the Consumer shall enjoy the legal warranty of conformity for a period of two years from the delivery of the Product.
  2. The legal warranty applies when, within the above terms, the Product has a conformity defect, that is, it appears:
  3. (a) not suitable for the use for which goods of the same type are normally used;
  4. (b) does not conform to the description made by ''Libra Nails Lab'' on the Site;
  5. (c) lacking the quality and usual performance of a good of the same type as the Customer can reasonably expect.
  6. In such cases, the consumer Customer has the right to restore, without charge, the conformity of the good by repair or replacement. If the replacement of the good is impossible or excessively burdensome for '''Libra Nails Lab''', the consumer Customer may, at his or her option, request a reasonable reduction in price or termination of the contract.
  7. The consumer customer shall forfeit these rights if he/she fails to report the lack of conformity to ''Libra Nails Lab'' within two months from the date of its discovery. Direct action to enforce defects fraudulently concealed by ''Libra Nails Lab'' shall be prescribed, in any event, within twenty-six months after delivery of the Product.
  8. The Customer must contact Customer Service indicating the nonconformity of the Products and follow the procedure for returning nonconforming Products that will be indicated to the Customer.
  9. Non-conforming Product must be returned to Libra Nails Lab.

Article 13 - Limits of Liability

  1. ''Libra Nails Lab '' assumes no responsibility for inefficiencies attributable to the courier, to the fact of a third party, to the fault of the Customer or force majeure/accident or any other event, including those dependent on malfunctions and interruptions of the Internet network, which is not under the exclusive control of ''Libra Nails Lab ''.
  2. These are causes of force majeure, by way of example but not limited to: accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, thefts and other similar events, measures of the Public Authority, the strike of its employees or carriers of which ''Libra Nails Lab'' makes use as well as any other circumstance beyond its control.
  3. The Customer is fully responsible for the purchase made on the Site and agrees to carefully read the instructions and warnings for the use of the Products purchased and to use them in accordance with these conditions.
  4. No liability can arise for '''Libra Nails Lab''' for any use of the Products that is not permitted, not in accordance with the instructions for use, and/or otherwise different from normal use.

 

Article 14 - Integrity

  1. The General Terms and Conditions, as well as any document expressly referred to therein, constitute the entire agreement between the Customer and "Libra Nails Lab" regarding the subject matter of the contract and supersede any previous agreement, understanding or arrangement between the same parties, whether oral or written.
  2. If one or more provisions of these General Terms and Conditions are deemed invalid or declared to be invalid under the law, the other provisions shall continue in full force and effect.

 

Article 15 - Dispute Resolution

  1. '' Libra Nails Lab '' informs its Customers that they may resolve any dispute arising from the proper application of this contract (including, but not limited to, disputes relating to validity, non-performance, default, total or partial and/or termination of the contract) through an online procedure (online dispute resolution procedure - "ODR procedure"), which can be activated by accessing the online platform made available by the European Commission at the following link http: //ec.europa. eu/consumers/odr.
  2. The parties have the option of resolving disputes between them before the competent judicial authorities or through another ADR ("Alternative Dispute Resolution") procedure.

 

 

 

 

Article 16 - Confidentiality of personal data

  1. The processing of the Customer's personal data will be carried out in compliance with the legal provisions on the protection of personal data, as better specified in the two privacy notices available in the appropriate section of the Site.

 

Article 17 - Applicable law and jurisdiction

These General Conditions are governed by Italian law also in accordance with the provisions of Part III, Title III, Chapter I, of Legislative Decree No. 206/2005, as amended by Legislative Decree No. 21/2014 so-called Consumer Code and the provisions of Legislative Decree No. 70/2003 on electronic commerce.

Without prejudice to the provisions of the Consumer Code on the non-derogation of the Consumer's Court, the exclusive competent Court for the resolution of any disputes arising from the application of these General Conditions of Sale is that of Vicenza.

 Article 18 - Reviews

The reviews published on the site are related to real customers who expose their opinion after having made a purchase.
All reviews, before publication, are subject to approval and verification of authenticity of the purchase , in order to avoid defamatory statements and / or that may put Libra Nails Lab in a bad light.


Article 19 - Invoicing

For professionals who wish to request an electronic invoice, it is necessary to contact our customer service at info@libranailslab.com or via Whatsapp at 351 9889151, communicating all the data for invoicing (order number, Company Name, VAT number, tax code ( if different from VAT number) SDI or PEC code , address , telephone number; upon receipt of the data we will issue the electronic invoice via SDI.
